These Terms and Conditions govern access to the EcoFoot website and the purchase, quotation, selection, delivery, and use of EcoFoot products and related services.

These Terms and Conditions (“Terms”) govern your access to and use of the EcoFoot website, online store, customer or representative portals, product-selection tools, quotation services, technical information, and related services.

These Terms also apply to quotations, orders, purchases, deliveries, and other commercial transactions involving products supplied under the EcoFoot brand by Eco Support Products (“EcoFoot,” “we,” “us,” or “our”).

By accessing our website, requesting a quotation, submitting an order, creating an account, or purchasing or using an EcoFoot product, you agree to these Terms. If you are acting on behalf of a company or other organization, you represent that you have authority to bind that organization.

If you do not agree with these Terms, do not use the website or submit an order through it.

1. About EcoFoot

EcoFoot supplies rooftop and equipment-support products for mechanical, electrical, plumbing, roofing, construction, industrial, and commercial applications.

Our products and services may include:

  • equipment stands and equipment-support frames;
  • pipe supports;
  • duct supports;
  • custom support products;
  • components and replacement parts;
  • technical drawings and product documentation;
  • installation guides and installation videos;
  • product-selection and quotation assistance;
  • automated product-recommendation tools;
  • order, delivery, warranty, and customer support; and
  • customer or representative portal services.

References to “products” in these Terms include standard products, configured products, custom products, components, and related documentation where applicable.

2. Eligibility and Authority

You must have the legal capacity to enter into a binding agreement to use our purchasing, quotation, or account services.

If you use our services for a business, employer, contractor, distributor, consultant, property owner, or other organization, you represent and warrant that:

  • you are authorized to act for that organization;
  • the information you provide is accurate and complete;
  • you are authorized to request quotations and place orders;
  • you are authorized to provide project and technical information; and
  • the organization agrees to these Terms.

We may refuse, suspend, or cancel access to an account, quotation, or order where we reasonably believe that the person submitting it lacks appropriate authority.

3. Website Use

EcoFoot grants you a limited, non-exclusive, non-transferable, revocable right to access and use the website for lawful business, purchasing, research, product-selection, and informational purposes.

You must not:

  • use the website for an unlawful, fraudulent, or misleading purpose;
  • interfere with the website’s security or operation;
  • attempt to gain unauthorized access to an account, server, system, or database;
  • introduce malware, malicious code, automated attacks, or harmful material;
  • scrape, harvest, copy, or systematically extract website data without permission;
  • circumvent access controls, rate limits, or technical restrictions;
  • impersonate another person or misrepresent your authority;
  • submit false product, project, billing, or delivery information;
  • use the website to infringe the rights of EcoFoot or another party; or
  • use EcoFoot content to create a misleading, competing, or unauthorized product offering.

We may restrict or terminate website access where we reasonably believe these Terms have been violated.

4. Website and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications, technical drawings, maximum load information, installation materials, compatibility information, inventory status, and other website content are accurate.

However, website content may contain errors, omissions, outdated information, or differences resulting from:

  • product revisions or manufacturing changes;
  • supplier-provided information;
  • data-entry or formatting errors;
  • photographic lighting, scale, or screen settings;
  • different product configurations;
  • regional availability;
  • website caching or synchronization delays; or
  • changes made after content was originally published.

Product photographs and illustrations may be representative only. Colours, finishes, proportions, components, packaging, and other visual details may vary.

We may correct errors, revise product information, or withdraw content without prior notice. Where a material error affects an unfulfilled order, we may contact you for instructions or cancel and refund the affected portion of the order.

5. Technical Information and Engineering Responsibility

Product specifications, loading information, drawings, installation materials, calculators, recommendations, and other technical content are provided to assist with product evaluation. They do not replace project-specific professional judgment.

Unless EcoFoot expressly agrees otherwise in a separate written professional-services agreement, EcoFoot does not provide architectural, structural, mechanical, electrical, roofing, code, safety, or professional engineering services.

The customer, purchaser, installer, contractor, consultant, engineer, architect, and property owner remain responsible for confirming:

  • the accuracy of project measurements and equipment information;
  • the suitability of each product for the intended application;
  • applicable loading and safety factors;
  • equipment weight, dimensions, centre of gravity, and operating conditions;
  • wind, seismic, vibration, snow, environmental, and dynamic-load requirements;
  • roof, structure, surface, and substrate capacity;
  • clearances, access, drainage, and maintenance requirements;
  • compatibility with roofing and waterproofing systems;
  • compliance with applicable laws, codes, standards, permits, and specifications;
  • the need for professional engineering or stamped drawings; and
  • proper installation, inspection, maintenance, and use.

A product’s stated maximum load does not mean that the product is appropriate for every installation at or below that load. Suitability depends on the complete configuration, number and placement of supports, cross-bar lengths, load distribution, equipment dimensions, site conditions, and other project-specific factors.

Do not rely on a product-selection result as approval of a complete project design.

6. Customer-Provided Information

Product selection, quotations, custom work, and order fulfilment may depend on information supplied by you or by another person involved in your project.

You are responsible for ensuring that all submitted information is:

  • accurate;
  • complete;
  • current;
  • legible;
  • internally consistent; and
  • authorized for disclosure to EcoFoot.

This includes:

  • equipment manufacturer and model number;
  • operating and shipping weight;
  • equipment length, width, and height;
  • support-point locations;
  • project drawings and specifications;
  • required cross-bar lengths and frame sections;
  • roof and site conditions;
  • installation requirements;
  • shipping and delivery details; and
  • billing and tax information.

EcoFoot is not responsible for errors, delays, unsuitable selections, additional costs, or product incompatibility resulting from inaccurate, incomplete, outdated, or misleading information supplied to us.

Changes submitted after a quotation or order may require re-evaluation, revised pricing, additional charges, or a new delivery date.

7. EcoFoot AI and Automated Recommendations

EcoFoot may provide automated product filters, calculators, recommendation tools, artificial intelligence, or similar software to assist users with product discovery and selection.

These tools may use information such as equipment manufacturer, model number, dimensions, operating weight, required support footprint, product specifications, and catalogue data.

Automated recommendations are intended to identify potentially suitable EcoFoot products based on the information available to the system. A recommendation does not constitute:

  • professional engineering advice;
  • architectural or structural approval;
  • confirmation of code compliance;
  • verification of roof or substrate capacity;
  • approval of an installation method;
  • a stamped drawing or professional certification;
  • a guarantee of project suitability; or
  • a substitute for reviewing the applicable technical documentation.

Automated tools may rely on third-party equipment specifications and other external data. Although we make reasonable efforts to improve accuracy, such information may be incomplete, outdated, or inconsistent.

Before ordering or installing a recommended product, you must verify the equipment model, dimensions, operating weight, product specifications, loading requirements, project conditions, and installation requirements.

Where the application is unusual, safety-critical, unclear, or outside standard product parameters, contact EcoFoot and obtain appropriate professional advice before proceeding.

8. Quotations and Estimates

A quotation or estimate is an offer to supply the products or services described in that document, subject to these Terms and any additional terms stated in the quotation.

Unless the quotation expressly states otherwise:

  • pricing is valid only for the validity period shown;
  • pricing applies only to the quantities and configuration quoted;
  • taxes, delivery, customs, duties, unloading, and installation may be additional;
  • lead times are estimates and not guaranteed delivery dates;
  • availability may change before the order is accepted;
  • changes to specifications may require revised pricing;
  • drawings and approvals may be required before production; and
  • a quotation does not reserve inventory or production capacity.

Where there is a conflict between a quotation and these Terms, the quotation will govern only for the specific commercial term it expressly modifies.

Customer purchase-order terms, vendor forms, portal terms, or other customer-provided conditions do not amend these Terms unless EcoFoot expressly accepts the amendment in writing.

9. Orders and Order Acceptance

An order submitted through the website, by purchase order, through a representative, or by another method is an offer to purchase. An automated order confirmation only confirms that we received the request.

An order is accepted only when EcoFoot expressly confirms acceptance, begins fulfilment, ships the products, or otherwise communicates that the order has been accepted.

We may refuse or cancel an order before fulfilment due to:

  • product unavailability;
  • pricing or product-information errors;
  • incomplete technical information;
  • credit or payment concerns;
  • suspected fraud or unauthorized activity;
  • shipping or geographic restrictions;
  • legal or regulatory requirements;
  • customer-requested changes;
  • inability to verify project or account information; or
  • circumstances beyond our reasonable control.

If we cancel a prepaid order, we will refund the amount paid for the cancelled products, subject to any lawful deductions or separately agreed charges.

10. Custom, Configured, and Made-to-Order Products

Certain EcoFoot products may be custom manufactured, cut, configured, assembled, ordered from a supplier, or otherwise prepared specifically for a customer or project.

Custom, configured, special-order, non-stock, or made-to-order products may require:

  • approved drawings;
  • confirmed specifications;
  • a deposit or full payment;
  • minimum quantities;
  • special manufacturing lead times; or
  • written authorization to begin production.

You are responsible for reviewing all drawings, specifications, quantities, dimensions, finishes, and product details before approval.

Once production, cutting, assembly, procurement, or customization has begun, the order may not be cancellable, returnable, or refundable except where required by law or expressly agreed by EcoFoot in writing.

Customer-requested changes may result in additional engineering, drafting, material, labour, restocking, cancellation, or shipping charges.

11. Pricing, Taxes, and Payment

Unless otherwise stated, website and quotation prices are shown in the currency identified at the time of purchase and exclude applicable taxes, duties, customs charges, shipping, unloading, installation, permits, and professional services.

You are responsible for all applicable sales taxes, harmonized sales taxes, goods and services taxes, duties, customs charges, brokerage fees, and other governmental assessments associated with the order.

Payment is due according to the terms shown at checkout, on the quotation, invoice, customer account, or approved credit arrangement.

We may require a deposit, full payment, credit approval, or other security before reserving inventory, commencing production, or shipping an order.

Overdue balances may be subject to lawful interest, collection costs, account suspension, shipment holds, or withdrawal of credit terms.

You must notify us promptly of any billing discrepancy. Withholding payment for an undisputed amount is not permitted solely because another part of an invoice is disputed.

12. Shipping and Delivery

Shipping and delivery dates are estimates unless EcoFoot expressly guarantees a date in writing.

Delivery may be affected by manufacturing schedules, inventory availability, carrier capacity, weather, border processing, labour disruption, supplier delays, project-site restrictions, and other circumstances beyond our reasonable control.

You are responsible for:

  • providing a complete and accurate delivery address;
  • identifying access restrictions and appointment requirements;
  • ensuring that the delivery location can safely receive the shipment;
  • providing suitable personnel and equipment for unloading;
  • paying redelivery, storage, detention, or address-correction charges;
  • inspecting the shipment promptly on arrival; and
  • recording visible loss or damage on the carrier’s delivery receipt.

Partial shipments may be made where commercially reasonable. Each shipment may be invoiced separately.

Risk of loss and title will transfer according to the applicable quotation, shipping term, invoice, or written agreement. Where no separate term is stated, risk of loss transfers when the products are delivered to the address provided by the customer, subject to any rights that cannot legally be excluded.

Consumer delivery rights imposed by applicable law remain unaffected.

13. Inspection, Shortages, and Shipping Damage

You must inspect products promptly after delivery.

Visible shipping damage, missing packages, or obvious shortages should be:

  • noted on the carrier’s delivery receipt before acceptance;
  • photographed where reasonably possible; and
  • reported to EcoFoot promptly with the order and shipment details.

Concealed damage, incorrect products, or quantity discrepancies should be reported promptly after discovery and before the products are installed, modified, or incorporated into a project.

Failure to provide timely notice may affect our ability to investigate the issue, make a carrier claim, replace a product, or provide another remedy, except where applicable law provides otherwise.

Do not discard damaged products or packaging until EcoFoot or the carrier confirms that they are no longer required for inspection.

14. Returns, Cancellations, and Refunds

Returns and cancellations are subject to EcoFoot’s applicable return policy, the terms of the quotation or order, product condition, and applicable law.

Before returning a product, you must contact EcoFoot and obtain return authorization. Unauthorized returns may be refused.

Unless otherwise agreed or required by law:

  • products must be unused, uninstalled, unmodified, and resalable;
  • products must be returned with their original packaging and documentation;
  • the customer is responsible for return shipping and related costs;
  • original shipping charges may be non-refundable;
  • approved returns may be subject to inspection and a restocking charge;
  • custom, configured, cut, special-order, and clearance products may be final sale; and
  • refunds will be issued only after the returned products are received and approved.

Products that have been installed, altered, damaged, weathered, misused, or incorporated into another product or project may not be eligible for return.

Nothing in this section limits a refund, cancellation, replacement, or other right that cannot be waived under applicable law.

15. Limited Product Warranty

EcoFoot products may be covered by a written product warranty, manufacturer warranty, quotation term, or other warranty documentation supplied with the product.

Warranty coverage, duration, exclusions, and remedies are governed by the applicable written warranty.

Unless the applicable warranty states otherwise, warranty coverage may be denied or limited where a problem results from:

  • incorrect product selection;
  • improper installation or assembly;
  • failure to follow instructions or technical documentation;
  • use beyond stated specifications or load limits;
  • uneven or unsuitable load distribution;
  • modification, drilling, cutting, welding, or repair not approved by EcoFoot;
  • misuse, abuse, neglect, accident, or vandalism;
  • normal wear, cosmetic change, or environmental exposure;
  • incompatible equipment, surfaces, roofing systems, or third-party components;
  • failure to inspect or maintain the product;
  • movement or failure of the supporting roof, structure, or substrate; or
  • information or specifications supplied incorrectly by the customer.

A warranty claim must include reasonable supporting information, which may include the order number, product identification, photographs, installation details, project information, and a description of the alleged defect.

Warranty remedies may include inspection, repair, replacement, credit, or refund, as determined under the applicable warranty and law.

16. Installation and Use

EcoFoot products must be installed, inspected, maintained, and used by appropriately qualified persons in accordance with:

  • the applicable product documentation;
  • approved project drawings and specifications;
  • manufacturer instructions for supported equipment;
  • roofing and waterproofing requirements;
  • professional engineering requirements;
  • site-specific safety procedures;
  • applicable building, mechanical, electrical, fire, and safety codes; and
  • all applicable laws, permits, and industry standards.

Installation guidance provided by EcoFoot is general information and may not address every site condition.

Products must not be loaded, modified, relocated, combined, or used in a way that is inconsistent with their specifications or the approved project design.

The installer and project professionals are responsible for final placement, spacing, anchoring where applicable, alignment, load distribution, protection of the roof or substrate, and post-installation inspection.

17. Accounts and Customer Portals

Certain features may require a customer, distributor, contractor, or representative account.

You are responsible for:

  • providing accurate registration information;
  • keeping account information current;
  • maintaining the confidentiality of login credentials;
  • restricting access to authorized users;
  • reviewing activity conducted through your account; and
  • notifying us promptly of suspected unauthorized access.

You are responsible for actions taken through your account unless the activity results directly from EcoFoot’s failure to use reasonable security measures.

We may suspend or terminate an account for misuse, non-payment, security concerns, fraudulent activity, legal requirements, or violation of these Terms.

18. Intellectual Property

The EcoFoot website and its contents are owned by EcoFoot, its affiliates, licensors, or content providers and are protected by applicable intellectual-property laws.

Protected content may include:

  • trademarks, trade names, and logos;
  • product names and branding;
  • website design and source code;
  • photographs and illustrations;
  • product descriptions and copy;
  • technical drawings and diagrams;
  • installation guides and videos;
  • catalogue information and databases;
  • software, calculators, and recommendation tools; and
  • reports, documents, and downloadable materials.

You may download or print product materials solely for evaluating, purchasing, specifying, installing, or maintaining genuine EcoFoot products.

You may not reproduce, modify, sell, sublicense, publish, reverse engineer, remove ownership notices from, or commercially exploit our content without written permission.

Use of EcoFoot drawings or specifications does not transfer ownership of the underlying intellectual property.

19. Third-Party Services and Content

Our website may use or link to third-party platforms and services, including Shopify, payment processors, shipping providers, mapping tools, video platforms, manufacturers, analytics providers, and external technical resources.

Third-party services are governed by their own terms, policies, and availability. EcoFoot does not control and is not responsible for independent third-party content, systems, security, or service interruptions.

A link or integration does not necessarily mean that EcoFoot endorses every statement, service, or practice of the third party.

20. Disclaimers

To the maximum extent permitted by law, the website and general informational services are provided on an “as available” and “as is” basis.

EcoFoot does not guarantee that:

  • the website will always be available, uninterrupted, or error-free;
  • all website content will always be complete or current;
  • every product will remain available;
  • estimated lead times will be achieved;
  • an automated recommendation will be appropriate for every project;
  • third-party equipment information will be error-free; or
  • the website will be free from all security threats or harmful components.

No oral or informal statement creates a warranty, guarantee, or contractual commitment unless it is included in an authorized written agreement.

Nothing in these Terms excludes any representation, condition, warranty, guarantee, or right that cannot lawfully be excluded.

21. Limitation of Liability

To the maximum extent permitted by applicable law, EcoFoot and its directors, officers, employees, representatives, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from the website, products, services, recommendations, or these Terms.

This may include loss of:

  • profit or revenue;
  • business opportunity;
  • anticipated savings;
  • use of equipment or property;
  • production time;
  • data;
  • goodwill; or
  • project or operational delay.

To the maximum extent permitted by law, EcoFoot’s aggregate liability arising from a specific product, order, or transaction will not exceed the amount paid to EcoFoot for the product or portion of the order giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited, including any liability imposed by applicable consumer-protection law.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold EcoFoot and its directors, officers, employees, representatives, contractors, and service providers harmless from third-party claims, losses, damages, liabilities, and reasonable costs arising from:

  • your material breach of these Terms;
  • false, inaccurate, or unauthorized information supplied by you;
  • your misuse of the website or an EcoFoot product;
  • installation or use contrary to applicable instructions or specifications;
  • an unauthorized modification of a product;
  • your violation of applicable law or another party’s rights; or
  • project design, installation, or professional services for which EcoFoot was not responsible.

This section does not require an individual consumer to indemnify EcoFoot where such an obligation would be prohibited or unenforceable under applicable law.

23. Force Majeure

EcoFoot will not be responsible for delay or failure caused by events beyond its reasonable control.

Such events may include:

  • natural disasters and severe weather;
  • fire, flood, epidemic, or public-health emergency;
  • war, terrorism, civil unrest, or government action;
  • labour disruption or transportation interruption;
  • carrier, supplier, or manufacturing failure;
  • material shortages;
  • power, telecommunications, or internet failure;
  • cyberattack or system outage;
  • border, customs, or regulatory delay; and
  • other events that could not reasonably have been prevented.

We may extend delivery or performance timelines, allocate limited inventory, substitute an equivalent component where appropriate, suspend performance, or cancel the affected portion of an order.

24. Privacy

EcoFoot’s collection, use, disclosure, retention, and protection of personal information are governed by our Privacy Policy.

By using the website or submitting information, you acknowledge that personal information may be processed as described in that policy.

The Privacy Policy should be read together with these Terms but remains a separate policy.

25. Governing Law and Disputes

These Terms and any dispute relating to them are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any rights that cannot legally be limited, the parties submit to the courts located in Ontario for disputes arising from these Terms, the website, or an EcoFoot transaction.

Before starting formal proceedings, the parties are encouraged to provide written notice of the dispute and make reasonable efforts to resolve it through good-faith discussion.

Nothing in these Terms prevents a consumer from making a complaint to an applicable consumer-protection authority or exercising a right available under mandatory law.

26. Changes to These Terms

We may update these Terms to reflect changes to our products, services, technology, business operations, or legal obligations.

The revised Terms will be posted on this page with an updated “Last Updated” date.

Unless otherwise stated, revised Terms apply to website use occurring after they are posted. The terms applying to an accepted order will generally be those in effect when the order was accepted, unless the parties agree otherwise or a change is required by law.

27. General Provisions

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in effect.

EcoFoot’s failure to enforce a provision is not a waiver of that provision or any other right.

You may not assign your rights or obligations under these Terms without EcoFoot’s written consent. EcoFoot may assign these Terms in connection with a reorganization, sale, financing, merger, or transfer of its business or assets.

Section headings are provided for convenience and do not limit the meaning of a provision.

Electronic communications, approvals, orders, and signatures may be used to the extent permitted by law.

These Terms, together with the applicable quotation, accepted order, invoice, written warranty, return policy, shipping policy, and Privacy Policy, form the agreement between the parties regarding the relevant transaction.
